Disciplinary & Grievance Support
Supporting a client during a disciplinary process. Alleged Racism
The Client & Their Needs
In person, on site HR attendance was required at a manufacturing client site to support the Director of the business who was conducting 3 disciplinary hearings. As disciplinary hearings and TU interactions are not usual day to day duties he was keen to have HR support throughout the process.
Actions
McKinney HR reviewed all information sent to each respondent to understand the detail.
We also reviewed client internal disciplinary procedures.
A pre meeting was set up with the Director to introduce how our HR Support/ Associate would play an active role throughout the process. This took place immediately prior to the hearings.
Deliverables
McKinney HR accompanied the Director to the 3 meetings which were held in succession to each other.
• They ensured all relevant policies were followed.
• Supported the Director including suggesting questions that they considered necessary at the hearings.
• Generally kept things “right” and on track.
• Suggested adjournments to support upset respondents or allow the Director to seek further advice including from their employment lawyer.
• Managed the expectations of the Union Representation.
• Took notes (non-verbatim) and typed up after each meeting
• Held a short debrief with the Director following each meeting to talk through any aspect of the notes.
Outcomes
The organisation had no dedicated HR Support on site and were delighted that McKinney HR helped them through the process.
They were also impressed that McKinney HR were able to attend 3 hearings within 2 days of their initial request.
The client reported back that they felt in a good place to move forward with their decisions on the 3 employees.
